Pick Your W/NBL 3×3 Squad Competition Terms and Conditions
TERMS AND CONDITIONS – PICK YOUR W/NBL 3×3 SQUAD COMPETITION
1. To be eligible to enter, during the Promotional Period, you must complete the “Pick your W/NBL 3×3 squad competition” conducted by Australia 3×3 Hustle Pty Ltd as trustee for Australia 3×3 Hustle Discretionary Trust ABN 71 464 229 202 (3×3) of Level 6, 10 Queens Road, Melbourne VIC 3004 by:
- provide your name and email address; and
- answer the question in 25 words or less: “In their prime, which 5×5 W/NBL legends would you put in your 3×3 squad and why?”; and
- provide the names of four former players (three players + one sub) in the comments section of the relevant 3x3Hustle social media post (Facebook and/ or Twitter and/ or Instagram)
2. There will be one prize winner. Entries will be judged based on insightfulness, thoughtfulness, creativity, originality, creativity and other measures determined by 3x3Hustle in their absolute discretion. All entries must be unique and the original work of the entrant. The entry must not be plagiarized in any way.
3. The Game of Skill (GoS) is conducted by 3x3Hustle and the prize will be fulfilled, and delivered by 3x3Hustle.
4. Entry into the GoS constitutes acknowledgement and acceptance of these terms and conditions. Information on how to enter, all entry instructions, advertising material and prize information form part of these terms and conditions.
5. Entry is open to:
- Australian residents only aged 16 and above.
- For the purposes of these Terms & Conditions, “Australian Resident” means a person who resides in Australia at the start of the Promotion Period and who holds Australian citizenship or holds an Australian permanent residency visa.
6. Employees of 3x3Hustle and its related bodies corporate (as that term is defined in the Corporations Act 2001 (Cth)) (Related Body Corporate) or immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or stepchild (whether natural or by adoption), parent, stepparent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, stepsister or first cousin are not eligible to enter.
7. Entries not completed in accordance with these Terms and Conditions are void. Entries will be deemed void if plagiarized, stolen, forged, mutilated or tampered with in any way.
8. Multiple entries are not permitted. Entrants can only enter in their own name. The use of automatic entry software, mechanical or electronic devices that allows an individual to automatically enter the GoS is prohibited and may render all entries submitted by that individual invalid.
9. 3x3Hustle reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who 3x3Hustle has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the GoS. Failure by 3x3Hustle to enforce any of its rights at any stage does not constitute a waiver of those rights. 3x3Hustle’s legal rights to recover damages or other compensation from such an offender are reserved.
10. Incomplete or indecipherable entries will be deemed invalid.
11. If there is a dispute as to the identity of an entrant, 3x3Hustle reserves the right, in its sole discretion, to determine the identity of the entrant.
12. 3x3Hustle’s decision is final and no correspondence will be entered into.
13. Entries for the GoS open at 6:00pm AEST on Tuesday 7th September 2021 and close at 6:00pm AEST on Tuesday 14th September 2021 (Promotional Period). All entries must be received by 3x3Hustle by 6:00pm AEST on Tuesday 14th September 2021. 3x3Hustle reserves the right to extend the survey period in which case the Terms and Conditions will be updated to reflect an extended period whereby the final date for all entries will be set, as well as a revised judging date.
14. Judging of the prize will be undertaken by 3x3Hustle at Level 6, 10 Queens Road, Melbourne, 12:00pm AEST on Friday 17th September 2021. The prize winner will then be notified by social media direct message. To claim the prize, the prize winner must respond to the direct message within 10 working days of the notification email being sent.
15. The prize is valued at AU$49.95 (inclusive of GST) as at September 2021. Each prize consists of one official Wilson 3x3Hustle basketball.
16. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
17. In the event that a winner cannot be contacted or the prize is unclaimed after 10 working days since the notification to the prize winner by email, a new prize winner will be selected in accordance with these Terms and Conditions and will be notified by email. The new prize winner will have 10 working days from notification to claim the prize, this process will continue until the prize has been claimed. 3x3Hustle will be in contact with the prize winner to arrange delivery of the prize. This will continue until a winner is successfully contacted and the prize delivered.
18. In the event that the prize is unavailable for any reason, at any time, 3x3Hustle reserves the right to either delay or substitute the prize with another prize of equal value and the prize winner will be notified accordingly.
19. Entrants consent to 3x3Hustle using their entry (including their answers), name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media or publication for an unlimited period without remuneration for the purpose of promoting this GoS (including any outcome), and promoting any products manufactured, distributed and/or supplied by 3x3Hustle and/or for compliance with the requirements of a relevant regulatory authority.
20. Entrants agree that 3x3Hustle will own all material submitted by the entrant as part of the 3x3Hustle and hereby assigns to 3x3Hustle all existing and future intellectual property rights in all such material. The entrant further acknowledges that all such existing intellectual property rights vest in 3x3Hustle on the date that the entry is submitted. The entrant warrants that all rights assigned to 3x3Hustle do not and will not infringe the intellectual property rights or moral rights of any person.
21. If this GoS is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of 3x3Hustle, including but not limited to technical difficulties, unauthorised intervention or fraud, 3x3Hustle reserves the right, in its sole discretion, to the fullest extent permitted by law:
- to disqualify any entrant; or
- subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the GoS, as appropriate.
- Any cost associated with accessing the website is the entrant’s responsibility and is dependent on the Internet service provider used.
22. 3x3Hustle assumes no responsibility for any failure to receive an entry in the Promotion or for inaccurate information by any person or for any loss, damage, or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, then 3x3Hustle may modify the Promotion.
23. Entrants agree that they are fully responsible for any materials they submit via the promotion including but not limited to comments, recordings, and images (Content). 3x3Hustle shall not be liable in any way for such Content to the full extent permitted by law. 3x3Hustle may remove or decline to publish any Content without notice for any reason whatsoever. Entrants warrant and agree that without limiting any other terms herein, the entrant agrees to indemnify 3x3Hustle for any breach of the above terms.
24. As a condition of entering this promotion, each entrant licenses and grants 3x3Hustle and their affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry (which shall include Content) for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability.
25. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the Australian Securities and Investments Commission Act 2001 (Cth) or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, 3x3Hustle (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
26. Except or any liability that cannot by law be excluded, including the Non-Excludable Guarantees, 3x3Hustle (including their respective officers, employees and agents) are not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:
- any technical difficulties or equipment malfunction (whether or not under 3x3Hustle’s control);
- any theft, unauthorised access or third-party interference;
- any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by 3x3Hustle) due to any reason beyond the reasonable control of 3x3Hustle;
- any variation in prize value to that stated in these Terms and Conditions;
- any tax liability incurred by a winner or entrant; or
- taking of the prize/attendance at the prize event
27. 3x3Hustle collects personal information (PI) in order to conduct the promotion and may, for this purpose, disclose such PI to each other and other third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. 3x3Hustle will also use, and handle PI as set out in its Privacy Policy available at https://www.3x3hustle.com/privacy-policy/
28. In addition to any use that may be outlined in the Privacy Policy identified above, 3x3Hustle may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of 3x3Hustle. 3x3Hustle may disclose Australian entrant’s PI to any entity outside of Australia in accordance with their respective Privacy Policies.
29. The laws of Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Melbourne, Victoria Australia.
